My name is Angela Kirkpatrick I am the director special education in Copperas Cove and I want to

answer a couple of questions about how Texas is different and about the

difference between medical and educational services we're going to

start with the difference between medical and educational because that is

one of the biggest components that our EFMP program on Fort Hood can help with

so when we talk about medical services you go to the doctor the doctor makes

the diagnosis develops a treatment plan and sometimes prescribes medication they

may or may not determine that there is a disability involved in the requirement

of a treatment plan or medication in the educational setting we determine if

there's a disability that meets eligibility criteria which is set by

state law we'll talk about that in just a moment and then we also if we

determine that there's a disability that meets eligibility criteria we develop an

individualized education plan or an IEP in Texas that's called a ARD committee

meeting which stands for admission review and dismissal the other component

is we've determined that there is a disability diagnosis or eligibility and

then we determine what services are appropriate so in medical in the medical

setting we may determine that occupational therapy is needed to help

you recover from an injury or to help with a treatment plan but occupational

therapy in the educational setting is designed to help you access school and

participate in the least restrictive setting possible so we have all of these

services that are available to students in the educational setting but the

purpose behind them may be different from what you have in a medical setting

now the other piece that you need to know is of all the eligibilities which

can be found in state law five of them require a physician's input where we

need to collaborate together those include orthopedic impairment traumatic

brain injury a visual impairment an auditory impairment and then other

health impairment is a category of eligibility that may include multiple

types of disabilities impacting a student's ability to participate in

school so more information can be gathered from that if you go to the

legal framework so it's governed by federal and state law federal the two

primary laws are IDEA individuals with Disabilities Education

Act and or 504 504 is protection from discrimination based on a disability and

then under IDEA it's how we educate students with disabilities then the

state is responsible each state is responsible for making legal decisions

on how we're going to implement those federal regulations more information can

be found with regard to special education at the legal framework so if

you go to Education Service Center 18 that's where that's housed

when we think about education we think about a continuum of service every

student has a right to be with their non-disabled peers as much as possible

that's in the general education setting when they begin to struggle in math or

reading or behaviorally we can implement an intervention program or RTI response

to intervention if that's not working we can consider which of these things is a

more appropriate means to address that concern and so 504 has the

ability to put a plan in place and then allows for some accommodations for

students with disabilities or conditions like dyslexia or diabetes and so we have

lots of students who are 504 for disabilities because they have a

disabling condition that affects a major life activity or we can consider whether

they need to be referred for a special education evaluation if that process

occurs the question is do they have an educational eligibility and do they have

a need for specialized support special education services or and/or related

services once we've done that we put goals in place and there are components

involved in the plan for their IEP to ensure that they are continuing to make

appropriately ambitious progress so it's important for you to understand if

you're struggling with navigating either of these I would encourage you to call
