EDINBURG, Texas – On Friday, McAllen agents arrested a Guatemalan national near La Joya,
Texas as he attempted to illegally enter the United States.
Record checks later confirmed the man is an active member of the 18th Street Gang.
That same day, agents stopped a Honduran man near Brownsville, Texas whose records confirmed
he is an active member of the Mara-Salvatrucha (MS-13) gang.
On Saturday, McAllen agents apprehended a Honduran man near Los Ebanos, Texas who had
been previously arrested by the Fairfax County, Virginia Sheriff's Office for sexual assault
of a child between 13 to 14 years of age.
The man was convicted and sentenced to five years in prison.
On Sunday, McAllen agents encountered a Salvadoran man near Cuevitas, Texas whose records indicated
he is an active member of the MS-13 gang.
Early Monday morning, agents arrested a Salvadoran man near Hidalgo, Texas whose criminal history
indicated he was charged and convicted of a second degree sex offense in Charles County,
Maryland where he was sentenced to 20 years confinement but released after six years.
All subjects will be processed accordingly.
Also, in EDINBURG, Texas The U.S. Border Patrol Rio Grande Valley Sector detected a high level
of illicit activity at the immigration checkpoints over the Memorial Day Weekend.
Starting Friday, May 25, through Monday, May 28, both the Falfurrias and Kingsville Border
Patrol Checkpoints experienced a high number of vehicles through their checkpoints.
The increased volume of traffic resulted in a total of 17 alien smuggling cases with 35
illegal aliens apprehended.
Additionally, agents stopped a total of four narcotic smuggling attempts resulting in the
seizure of 90 pounds of marijuana and a small amount of cocaine.
"The danger involved with these smuggling tactics are magnified when combined with the
extreme summer temperatures of South Texas," said Chief Patrol Agent Manuel Padilla, Jr.
"We will continue to work with our local, state and federal partners to ensure prosecution
on all people who assist in the facilitation of these types of smuggling attempts.
All cases are being referred for prosecution.
All subjects were offered medical attention and will be processed accordingly.

my name is Eric Benavides and I'm a Texas criminal defense lawyer I want to
talk to you today about the possibilities of being drug tested in
court. My clients asked me all the time could I
potentially be drug tested when I go to court and the answer is yes you could.
Now the chances are higher if you're on pretrial conditions or if you're out on
a PR bond and somebody's checking in on you while your case is pending. You can
also be sent for a drug test if you show up late to court or if you do something
that causes the judge to become upset with you, these are bond conditions that
the judge can check on. Now the courts understand that you could test positive
for certain drugs for up to 30 days, such as marijuana, but they will give you time
to clean up but if you test positive after that amount of time you run the
risk of losing your bond. So the answer is yes you could potentially be drug
tested, so after being arrested you should stop using drugs because using
drugs could land you in jail.
