There's a new Medical Treatment
Planning and Decisions Act
that's being implemented on the 12th of March this year
the new legislation repeals the old Medical Treatment Act
to make patient wishes more clear
and more easy for health professionals to understand
the new act provides a clear process
for treatment consent
for people who are medically unable to make
a decision for themselves at that time
importantly it separates a values directive
from an instructional directive
this allows patients to express their values
and what's important to them
and then to go on to write an instructional directive
something that must be followed if they wish
we know that most patients
really just want their values to be recognised
and considered in decision making
so the new legislation fits much better
with the way that people think and behave
and want to be respected
the new act also makes it clearer
who the decision maker is
when a patient hasn't appointed a particular individual
it also gives that decision maker more clarity
about what they're allowed and able to decide
for the patient
It's important to note that the act specifically says
that old advance care plans that are already in place
continue to be valid
importantly for health care professionals
it means that patient's wishes are better respected
so all this leads to better patient centred care
better outcomes
and more comfort for health professionals
and for families that good decisions are being made
